Legislative Update: The Safer Beauty Bill Package was reintroduced in the 119th Congress in July 2025. The bill numbers changed with the new congress, and the content of the bills was updated, reflecting the evolving cosmetic safety legislative, market, and scientific landscapes.

The Modernization of Cosmetics Regulations Act of 2022 represents the biggest step forward for cosmetics regulation since 1938 (read our analysis). Despite this important progress, much work remains to be done to achieve a truly health-protective safety standard for cosmetics. That’s where the Safer Beauty Bill Package comes in.

Key Facts

These bills cover almost every aspect of personal care product safety. They will:

  • Ban the worst first: Ban 18 of the most hazardous chemicals, including mercury, parabens, lead, asbestos, and toluene, plus the chemical classes of formaldehyde-releasing preservatives and ortho-phthalates. CA, MD, OR, WA, VT, and the European Union already ban some or all of these chemicals from cosmetic products, yet they are used in cosmetic products sold legally in the U.S.Defend the health of women of color and salon workers: These two vulnerable populations are among the most highly exposed to toxic chemicals because of the products marketed to them and those commonly found in their workplaces.
  • Reveal hazardous chemicals, including secret fragrance and flavor ingredients: Require the disclosure of the unlabeled, and often toxic fragrance and flavor ingredients in retail cosmetic and professional use salon products on labels and websites. Plus, require brand owners to identify any ingredient in their cosmetic product that is linked to a serious negative impact on human health.
  • Force supply chain transparency so cosmetic companies can get the information they need from their upstream suppliers to make safer products.
